這裡的意思是得到國會和所在州議會的同意就可以了，套用在關島就是得到夏州、關島議會和國會同意就可以，不能算是違反憲法，反正本來讓關島加入夏州就要兩地議會同意，關島改變任何法定地位都要國會同意

是中文翻译的问题。
英文原文，“but no new States shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States” 这里no和nor显然是一个整体，所以后面“without the Consent of the Legislatures of the States concerned as well as of the Congress”这里是用来限制前面两段的，而不是只限制了第二段nor后面的条款。

所以说只要国会批准，在一州内部或是几个州局部联合建立新州都是合宪的。
